Terms and Conditions – UK Bricks and Slips
1. Introduction
Welcome to UK Bricks and Slips, a trading name of Chiltern Brick & Tile Ltd (“we”, “us”, “our”).
These Terms and Conditions govern all transactions between us and you, whether you are acting as a consumer (B2C) or a business customer (B2B).
By placing an order with us through our website, by phone, by email, by payment link, or by any other method, you agree to be bound by these Terms and Conditions.
2. Definitions
Consumer (B2C): A private individual buying goods for personal use and not in the course of business.
Business Customer (B2B): A company, sole trader, partnership, contractor, builder, developer, merchant, landlord, trade buyer, or any person buying goods wholly or mainly for business purposes.
Goods: Bricks, brick slips, specials, accessories, samples, or any other products supplied by us.
Special Order Goods: Goods that are bespoke, custom-made, cut-to-size, personalised, specially sourced, made-to-order, manufactured to order, or ordered specifically for you.
3. Orders and Acceptance
3.1 Orders placed via our website, phone, email, payment link, or any other method constitute an offer to purchase.
3.2 We reserve the right to accept or reject any order at our discretion.
3.3 All orders are subject to product availability and confirmation of the order price.
3.4 Any typographical, clerical, pricing, product description, or other error or omission in any sales literature, quotation, website listing, price list, order confirmation, invoice, or other document may be corrected by us without liability.
3.5 An order is not accepted by us until we have confirmed acceptance, received payment where required, and confirmed that the goods are available for supply.
3.6 We reserve the right to cancel or refund an order where goods are unavailable, incorrectly priced, incorrectly described, or where delivery cannot reasonably or safely be made.
4. Delivery
4.1 Deliveries are made kerbside only unless otherwise agreed in writing.
4.2 It is your responsibility to ensure that the delivery address has suitable access for large delivery vehicles.
4.3 Deliveries are usually made using third-party hauliers and may involve large vehicles, pallet networks, tail-lift vehicles, articulated lorries, rigid lorries, or other commercial delivery vehicles.
4.4 Delivery can only be made where the haulier or driver considers it safe and lawful to do so. The driver is not obliged to move goods across gravel, grass, uneven surfaces, soft ground, steep slopes, narrow access routes, into garages, into buildings, into rear gardens, or onto driveways where this may cause damage or risk.
4.5 You must notify us before delivery of any access issues, including narrow roads, weight restrictions, low bridges, steep hills, restricted access, red routes, parking restrictions, pedestrian zones, time restrictions, gravel drives, soft ground, or any other factor that may affect delivery.
4.6 Failure to notify us of access issues may result in failed delivery charges, re-delivery charges, storage charges, or cancellation charges.
4.7 Someone must be present to receive and sign for the delivery unless otherwise agreed in writing.
4.8 If no one is present and goods are left at the delivery location, you accept responsibility for the goods from the point they are left.
4.9 Delivery dates and times are estimates only and are not guaranteed.
4.10 We accept no liability for costs incurred due to delivery delays, failed deliveries, or delivery issues, including labour costs, subcontractor costs, equipment hire, project delays, missed appointments, or site downtime.
4.11 You should not book builders, contractors, equipment, or installation work until your goods have arrived in full and have been inspected.
4.12 Failed deliveries due to access issues, site refusal, customer absence, unsafe delivery conditions, or incorrect delivery information will incur a re-delivery charge. This will usually be charged at the same rate as the original delivery charge, unless the actual cost is higher.
5. Returns and Cancellations
5.1 Consumers (B2C)
5.1.1 If you are buying as a consumer, you may cancel your order within 14 days of receiving the goods, unless the goods are excluded from cancellation rights.
5.1.2 Goods excluded from cancellation rights include bespoke, custom-made, cut-to-size, personalised, special-order, made-to-order, manufactured-to-order, or goods sourced specifically for you.
5.1.3 To cancel, you must notify us clearly by email within the 14-day cancellation period.
5.1.4 After notifying us of cancellation, you have a further 14 days to return the goods to us.
5.1.5 Goods must be returned unopened, unused, in their original packaging, on their original pallets where applicable, in full packs, and in a resaleable condition.
5.1.6 You are responsible for the cost of returning the goods to us. Due to the weight and nature of bricks, brick slips, and building materials, return haulage or collection charges can be significant and may be similar to, or greater than, the original delivery charge.
5.1.7 Where cancellation rights apply, we will refund the price paid for the goods and the standard outbound delivery charge, where required by law.
5.1.8 If you selected or requested a delivery service more expensive than our standard delivery option, we will only refund the amount equivalent to our standard delivery charge.
5.1.9 Any refund will only be made once the goods have been returned to us, or once you have provided evidence that they have been returned.
5.1.10 We may deduct from the refund any loss in value caused by handling, opening, damage, repacking, pallet damage, contamination, incomplete packs, missing items, or any condition that means the goods are not fit for resale.
5.1.11 We do not accept returns of part packs, opened packs, goods not on their original pallets, goods damaged after delivery, goods that have been installed, laid, cut, altered, mixed, or otherwise used, or goods that are not in resaleable condition.
5.1.12 If returned goods are deemed not fit for resale after inspection, no refund will be issued for those goods, and any reasonable storage, disposal, or onward return cost will be your responsibility.
5.1.13 Refunds will normally be processed within 14 days of receiving the returned goods, or within 14 days of receiving evidence that the goods have been returned, whichever is earlier.
5.2 Businesses (B2B)
5.2.1 Business customers have no automatic right to cancel or return goods unless otherwise agreed by us in writing.
5.2.2 Any return agreed by us is entirely at our discretion.
5.2.3 Any returns agreed may be subject to a restocking fee, typically 25%, or such other amount as we reasonably determine.
5.2.4 Goods must be returned in resaleable condition within 14 days of our approval.
5.2.5 Return delivery is charged at the same rate as the original delivery charge unless the actual cost is higher.
5.2.6 Goods must be returned on the original pallets, unopened, unused, in full packs, and in resaleable condition.
5.2.7 Custom-made, special-order, made-to-order, cut, altered, bespoke, or specially sourced items are non-refundable.
5.2.8 For business customers, goods correctly supplied in accordance with the order cannot be rejected or returned because they do not match website images, existing brickwork, a third-party preference, a customer’s client expectation, or a sample not supplied or approved by us, unless we have expressly guaranteed a match in writing before the order was placed.
5.2.9 Rejection by the business customer’s own client, homeowner, architect, contractor, developer, designer, buyer, or other third party shall not by itself be grounds for cancellation, return, refund, or rejection of the goods where the goods supplied are the goods ordered.
6. Damages and Shortages
6.1 All goods must be inspected on delivery.
6.2 Any damages, shortages, or incorrect goods must be reported to us within 24 hours of delivery with clear photographic evidence.
6.3 We are not responsible for damage, shortages, or incorrect goods reported after this period unless required by law.
6.4 Minor chips, scuffs, edge damage, colour variation, shade variation, and texture variation are common in clay products and do not automatically constitute faults.
6.5 You must not use, install, lay, cut, mix, alter, or otherwise use any goods that you believe are damaged, incorrect, defective, unsuitable, or not as expected.
6.6 Use, installation, cutting, mixing, alteration, or laying of the goods may be treated as acceptance of the goods.
6.7 We may require return or collection of damaged, incorrect, or defective goods before issuing a refund, replacement, or credit.
6.8 Where replacement goods are supplied, we are not responsible for labour, installation, removal, equipment, delay, or other associated costs.
7. Product Description, Colour, Samples and Matching
7.1 Bricks, brick slips, specials, and related clay products are manufactured from natural materials and may vary in colour, shade, texture, size, finish, and appearance. Such variations are normal and do not constitute a fault.
7.2 Product images, website photographs, brochures, sample panels, showroom displays, and marketing images are provided for general guidance only.
7.3 The appearance of products may vary due to lighting, photography, screen settings, weathering, manufacturing variation, firing variation, and batch differences.
7.4 It is the customer’s responsibility to ensure that the product ordered is suitable for their intended use, project, design, specification, client requirements, planning requirements, and site conditions before placing an order.
7.5 We strongly recommend that all customers order samples before placing a full order, especially where colour, texture, finish, matching, planning approval, client approval, or design approval is important.
7.6 Samples are for guidance only and do not guarantee an exact match to delivered goods.
7.7 If you require bricks or slips to match existing brickwork, adjoining materials, planning requirements, architect specifications, client expectations, or a previous batch, you must notify us clearly before placing your order and provide suitable photographs, sample bricks, manufacturer details, batch information, or other relevant information.
7.8 We do not guarantee a match unless this has been expressly agreed by us in writing before the order is placed.
7.9 Where a customer places an order without requesting a sample, without providing matching information, or without asking us to assist with a match before ordering, the customer accepts responsibility for the product selection and accepts the risk that the goods may not match existing brickwork, website images, samples, expectations, or third-party requirements.
7.10 For business customers, including builders, contractors, developers, merchants, and trade buyers, rejection by the customer’s own client, architect, contractor, homeowner, buyer, designer, or other third party shall not by itself be grounds for cancellation, return, refund, or rejection of the goods where the goods supplied are the product ordered.
7.11 Goods must not be installed, laid, cut, mixed, altered, or used if there is any concern about colour, shade, texture, suitability, damage, defect, batch variation, or incorrect supply.
7.12 Use, installation, cutting, mixing, alteration, or laying of the goods may be treated as acceptance of the goods.
7.13 We recommend ordering the full quantity required for a project in one order. We cannot guarantee that later orders will be from the same batch or will match previous deliveries.
7.14 Any advice, product guidance, matching assistance, or estimate provided by us is given in good faith based on the information supplied by you. The final responsibility for product selection remains with the customer unless we have expressly agreed otherwise in writing.
8. Suitability and Use
8.1 It is your responsibility to ensure that the goods are suitable for the intended use, location, design, installation method, exposure conditions, and project requirements.
8.2 You are responsible for ensuring that goods comply with any planning conditions, building regulations, architect specifications, client requirements, or other approvals relevant to your project.
8.3 We are not responsible for goods being unsuitable where you have not provided full and accurate project requirements before ordering.
9. Liability
9.1 Our liability is limited to the cost of the goods supplied.
9.2 We accept no responsibility for consequential or indirect losses.
9.3 We accept no responsibility for costs associated with project delays, labour, equipment, scaffolding, plant hire, subcontractor charges, loss of profit, loss of business, loss of opportunity, or third-party claims.
9.4 We accept no liability for delays caused by third-party hauliers, manufacturers, suppliers, weather, traffic, access restrictions, stock shortages, or events outside our reasonable control.
9.5 Nothing in these Terms and Conditions limits our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded.
10. Pricing and Payment
10.1 Prices are quoted in GBP.
10.2 Prices exclude VAT unless otherwise stated.
10.3 Delivery charges are shown separately where applicable.
10.4 Payment is due at the point of order unless otherwise agreed in writing.
10.5 We reserve the right to cancel unpaid orders or delay dispatch until funds have cleared.
10.6 Prices, delivery charges, and availability may change without notice before an order is accepted.
10.7 Where a pricing error has occurred, we reserve the right to cancel the order and issue a refund.
11. Ownership and Risk
11.1 Risk in the goods passes to you on delivery.
11.2 Goods remain our property until paid for in full.
11.3 Once risk has passed to you, you are responsible for safe storage, protection, security, and insurance of the goods.
12. Storage and Delayed Delivery
12.1 Where goods are ready for delivery and you request a delay, we may charge storage costs.
12.2 If delivery is delayed due to your failure to accept delivery, provide access, provide correct information, or make payment, we may charge storage, re-delivery, cancellation, or administration costs.
13. Website Information
13.1 We aim to keep website information accurate and up to date, but we do not guarantee that all product descriptions, images, prices, availability, or technical information are free from error.
13.2 Website images and descriptions are for general guidance only and should not be relied upon as the sole basis for product selection where exact colour, texture, finish, size, or suitability is important.
13.3 Customers should contact us before ordering if they require clarification, technical information, matching assistance, or confirmation of product suitability.
14. Governing Law
14.1 These Terms and Conditions are governed by the laws of England and Wales.
14.2 Any disputes will be subject to the jurisdiction of the English courts.
